If you are completing an oath or affirmation - make sure the notary performs the
oath. They should say something to the effect of, "Do you swear or
affirm..." Here is the definition per the North Carolina General
Provisions:
Oath. - A notarial act which is legally equivalent
to an affirmation and in which a notary certifies that at a single time and
place all of the following occurred:
a. An individual appeared in person before
the notary.
b. The individual was personally known to
the notary or identified by the notary through satisfactory evidence.
c. The individual made a vow of truthfulness
on penalty of perjury while invoking a deity or using any form of the word
"swear".

Make sure that you are signing the journal entry
for your notarization. This will help protect you and the notary in the
future should the need arise. This is very important. If the notary
does not ask you to do this, please ask them!

Have questions about the notarization process,
requirements, or legalities? Here are some of the questions that I have
been asked...
Q: Are you currently an active notary in the
State of North Carolina?
A: Yes, I am an active notary in the State
of North Carolina.
Q: What types of notarial acts are you
authorized to perform?
A: I am authorized to perform acknowledgments,
jurats, oaths, affirmations, verifications, and other notarial acts as permitted
by North Carolina law. You can see my list provided on this page.
Q: What is the difference between an
acknowledgment and a jurat?
A: An acknowledgment is when a signer
declares to a notary that they signed a document voluntarily. A jurat
involves the signer making a sworn statement under oath before the notary.
Q: What documents are acceptable for ID in
NC notarizations?
A: At least one current document issued by a
federal, state, or federal or state-recognized tribal government agency bearing
the photographic image of the individual's face and either the signature or a
physical description of the individual.
Q: Are there any types of documents you are
not allowed to notarize?
A: I cannot provide legal advice, so I am
unable to notarize documents that I believe are illegal, fraudulent, or
improper. I cannot notarize documents in which I have a personal interest.
I also will not notarize a document if valid ID is not provided.
Q: Can you refuse to notarize my document?
A: Absolutely!
Q: Do you keep a record the notarial acts
you perform?
A: Yes. I maintain a record of all
notarial acts as required by North Carolina law in my notary journal.
Q: I live in Fayetteville and you are
located in Rutherford County…can you notarize my documents even though I don’t
live in your county?
A: Yes. I have statewide jurisdiction
to notarize in any of the 100 counties in North Carolina.
Q: What fees do you charge for notary
services?
A: The fees for notary services are regulated by
the State of North Carolina. I can charge $10.00 per principal signature
and $0.655 per mile for mileage.
Q: Can you provide certified copies of
documents?
A: No. Notaries in North Carolina are
not authorized to provide certified copies of documents. You would need to
contact the appropriate issuing authority for certified copies.
Q: How do you ensure the authenticity of the
documents you notarize?
A: I verify the identity of the signer
using acceptable forms of identification, witness the signing of the document,
and attach an official notarial seal and signature to the document.
Q: Can you explain the role of a notary
public and its significance in legal documents?
A: Certainly. A notary public is an official
appointed by the state government to serve as an impartial witness when
important documents are signed. I verify the identity of the parties involved
and ensure that they are signing willingly and knowingly, which adds a layer of
authenticity and credibility to the documents
Q: Are there any specific requirements for a
document to be eligible for notarization?
A: Yes. The document must be complete
and ready for signatures. I cannot provide legal advice, so it is important that
the parties understand the contents of the document before presenting it for
notarization.
Q: How do you ensure that the notarization
process remains impartial and unbiased?
A: It's crucial for me to remain impartial
and unbiased during the notarization process. I have no personal interest in the
documents being signed, and I am here solely to verify the identity of the
